NO. 756/MPP/Kep/12/2003 ON
IMPORT OT UN-NEW CAPITAL GOODS

Attachment
Considering:
- a. that, in relation to the enforcement of system of classification of imported goods as contained in Decree of Minister of Finance No. 545/KMK.01/2003 and in the framework of effectiveness in the implementation of policy on import of un-new capital goods and in giving an equal opportunity for the current reconditioning industry and enhancement of investment domestically, it is necessary to amend Decree of Minister of Industry and Trade No. 755/MPP/Kep/12/2003 on Import of Un-New Capital Goods;
- b. that, for that purpose, Decree of Minister of Industry and Trade needs to be issued.
In view of:
Decree of Minister of Industry and Trade No. 756/MPP/Kep/12/2003 on Import of Un-New Capital Goods;
DECIDES:
To stipulate:
DECREE OF MINISTER OF INDUSTRY AND TRADE ON AMENDMENT TO DECREE OF MINISTER OF INDUSTRY AND TRADE NO. 756/MPP/Kep/12,/2003 ON IMPORT OT UN-NEW CAPITAL GOODS.
Article 1
(1) Amending list of un-new capital goods that cannot be imported as specified in Appendix I to Decree of Minister of Industry and Trade No. 756/MPP/Kep/12/2003 so that it becomes that as specified in the Appendix to this Decree.
(2) Pursuant to Decree of Minister of Finance No. 545/KMK.01/2003, the amendment as referred to in paragraph 1 shall start to be enforceable from January 1, 2004.
Article 2
(1)
- a. With the stipulation of this Decree, other provisions in Decree of Minister of Industry and Trade No. 756/MPP/Kep/12/2003 and the licenses and approvals for import, which have been issued in the framework of enforcement of the said Decree No. 756/MPP/Kep/12/2003, shall still be applicable until expiration of those licenses and approvals.
- b. All licenses and approvals for import, as referred to in clause a shall be deemed to have complied with the amendment as set forth in Article I to this Decree and shall be implemented according to list of tariff correlations tables based on the provisions on tariff of import duty as set forth in Decree of Minister of Finance No. 545/KMK.01/2003.
(2) This Decree shall come into effect from date of stipulation.
For public cognizance this Decree shall be enacted by placing it in the State Gazette of the Republic of Indonesia.
